Copyright Policy

How Data.co responds to notices of alleged copyright infringement on data.co, app.data.co, and the Data.co Marketplace, including datasets supplied by third-party providers. We respect intellectual property rights and expect our users and providers to do the same.

1. Policy

Our approach.

Data.co responds to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and other applicable law. This policy covers content on data.co, including the blog and graphics, content in app.data.co, and datasets distributed through the Marketplace.

Before sending a notice, consider whether the use may be permitted, for example because the material is in the public domain (as most court opinions and US federal government works are), is used under a license, or is a fair use. See Dataset Licensing for how public-domain materials and licensed content are distinguished.

2. Submitting a notice

A notice of claimed infringement must include:

  • Your physical or electronic signature, as the owner or a person authorized to act for the owner
  • Identification of the copyrighted work claimed to be infringed, or a representative list if multiple works are covered
  • Identification of the material claimed to be infringing, with enough detail for us to locate it, such as a dataset name, record identifier or URL
  • Your contact information: name, postal address, telephone number, and email address
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner
3. Designated agent

Where to send notices.

4. Process and timelines

What happens after a notice.

  1. 1

    Review (within 7 days)

We review the notice for completeness within 7 days of receipt. If it is incomplete, we tell you what is missing. An incomplete notice may not be acted on.

  2. 2

    Removal (expeditiously)

For a complete notice, we expeditiously remove or disable access to the material identified, normally within 7 days of determining the notice is complete.

  3. 3

    Notification

We notify the user who posted the material or, for a Marketplace dataset, the dataset's provider, and provide a copy of the notice, which may include your contact details.

  4. 4

    Counter-notice

The affected party may submit a counter-notice (section 5). We forward a valid counter-notice to the claimant.

  5. 5

    Restoration (10–14 business days)

We restore the material between 10 and 14 business days after receiving a valid counter-notice, unless the claimant first notifies us that it has filed a court action seeking to restrain the alleged infringement.

5. Counter-notices

A counter-notice must include:

If you believe material was removed by mistake or misidentification, you may send a counter-notice. Consider seeking legal advice first.

  • Your physical or electronic signature
  • Identification of the material that was removed or disabled and where it appeared before removal
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification
  • Your name, postal address and telephone number
  • A statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which Data.co may be found) and that you will accept service of process from the person who submitted the original notice or that person's agent
6. Repeat infringers and misrepresentation

Accountability on both sides.

Repeat infringers. In appropriate circumstances, we terminate the accounts of users, and end relationships with providers, that are repeat infringers. We consider the number of valid notices, whether counter-notices were filed and succeeded, and the nature of the infringement. A notice that is withdrawn, or overturned by a successful counter-notice, does not count.

Misrepresentation. Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. Do not send notices about material you have not considered for fair use or public-domain status.

7. Marketplace datasets

Claims about provider datasets.

Marketplace datasets are supplied by providers, who represent that they have the rights needed to license them. We pass claims about a dataset through to its provider, which is responsible for responding and, where needed, correcting its dataset at source. Providers must respond to forwarded claims promptly and cooperate with counter-notices.

We may suspend affected records or a whole dataset while a claim is resolved. If records are removed, we notify licensees whose Dataset License requires them to delete copies. Providers that repeatedly supply infringing material are subject to the repeat infringer policy.

This policy does not change any provider's warranties or indemnities to licensees under its Dataset License.
